EFFICIENCY PROMOTION OF INQUIRY POLICE OFFICERS BY BUDDHADHAMMA

Abstract

This dissertation aims to: (1) study the investigation process undertaken by inquiry officers; (2) examine Buddhist principles that promote and support the investigation process of inquiry officers; (3) integrate Buddhist principles to enhance the efficiency of inquiry officers; and (4) present a body of knowledge on “Integrating Buddhist Principles to Enhance the Efficiency of Inquiry Officers.” This research employed a documentary research methodology by examining information from relevant documents and research studies, together with in-depth interviews with 16 participants. The data were analyzed and presented through inductive analysis and content analysis. The research findings revealed that: The investigation process undertaken by inquiry officers has developed alongside human society and plays a significant role in seeking the truth, collecting evidence, and administering justice in accordance with the principles of law, impartiality, and equality. This is consistent with the concept of justice, which aims to protect the rights of all members of the public. The Buddhist principles that promote and support the investigation process include the Four Sublime States of Mind (Brahmavihāra 4), the Four Biases (Agati 4), and the Kālāma Sutta (the Ten Principles of the Kālāma Sutta). The Four Sublime States of Mind help cultivate compassion and impartiality; the Four Biases help prevent prejudice and partiality in determining facts; and the Ten Principles of the Kālāma Sutta promote the use of reason and careful examination of evidence. These principles contribute to investigations that are accurate, transparent, and fair. The integration of Buddhist principles into the duties of inquiry officers contributes to the development of morality, ethics, justice, and operational efficiency. It enables inquiry officers to perform their duties with honesty and impartiality while adhering firmly to facts and the rule of law. Consequently, such integration contributes to strengthening public confidence in the justice system and promoting sustainable social development. The body of knowledge derived from integrating Buddhist principles with the duties of inquiry officers can be summarized as the research knowledge framework known as IDJC, comprising: I = Investigation, referring to careful and thorough examination; D = Dedication, referring to performing duties with commitment and dedication; J = Justice, referring to performing duties with fairness and justice; and C = Circumstance, referring to considering all relevant circumstances comprehensively. This framework is grounded in the concept of “Enhancing the Efficiency of Inquiry Officers According to Buddhist Principles,” which serves as a key foundation for achieving accuracy, fairness, and transparency in accordance with the principles of law.

ดุษฎีนิพนธ์นี้มีวัตถุประสงค์ คือ 1) เพื่อศึกษากระบวนการสอบสวนของพนักงานสอบสวน 2) เพื่อศึกษาหลักพุทธธรรมที่ส่งเสริมกระบวนการสอบสวนของพนักงานสอบสวน 3) เพื่อบูรณาการส่งเสริมประสิทธิภาพของพนักงานสอบสวนตามหลักพุทธธรรม 4) เพื่อนำเสนอองค์ความรู้เกี่ยวกับ “บูรณาการส่งเสริมประสิทธิภาพของพนักงานสอบสวนตามหลักพุทธธรรม” ซึ่งงานวิจัยนี้ เป็นการวิจัยเอกสาร โดยศึกษาข้อมูลจากเอกสารและงานวิจัยที่เกี่ยวข้อง การสัมภาษณ์เชิงลึกจำนวน 16 รูป/คน และนำเสนอด้วยการวิเคราะห์แบบอุปนัยและเนื้อหา ผลการวิจัยพบว่า กระบวนการสอบสวนของพนักงานสอบสวนมีพัฒนาการควบคู่กับสังคมมนุษย์ โดยมีบทบาทสำคัญในการแสวงหาความจริง รวบรวมพยานหลักฐาน และอำนวยความยุติธรรมตามหลักกฎหมาย ความเป็นกลาง และความเสมอภาค สอดคล้องกับแนวคิดความยุติธรรมที่มุ่งคุ้มครองสิทธิของประชาชนทุกฝ่าย หลักพุทธธรรมที่ส่งเสริมกระบวนการสอบสวน ได้แก่ พรหมวิหาร 4 อคติ 4 และ กาลามสูตร 10 โดยพรหมวิหาร 4 ช่วยเสริมสร้างเมตตาและความเป็นกลาง อคติ 4 ช่วยป้องกัน ความลำเอียงในการวินิจฉัยข้อเท็จจริง และกาลามสูตร 10 ส่งเสริมการใช้เหตุผลและการตรวจสอบพยานหลักฐานอย่างรอบคอบ ส่งผลให้การสอบสวนมีความถูกต้อง โปร่งใส และเป็นธรรม การบูรณาการหลักพุทธธรรมกับการปฏิบัติหน้าที่ของพนักงานสอบสวนช่วยพัฒนาด้านคุณธรรมจริยธรรม ความยุติธรรม และประสิทธิภาพในการทำงาน ทำให้สามารถปฏิบัติหน้าที่ด้วยความซื่อสัตย์ เป็นกลาง ยึดมั่นในข้อเท็จจริงและหลักนิติธรรม อันนำไปสู่การเสริมสร้างความเชื่อมั่นของประชาชนต่อกระบวนการยุติธรรมและการพัฒนาสังคมอย่างยั่งยืน องค์ความรู้ที่ได้จากการบูรณาการหลักพุทธธรรมกับการปฏิบัติหน้าที่ของพนักงานสอบสวน สามารถสรุปออกมาเป็นองค์ความรู้ของวิจัยที่เรียกว่า IDJC Model. องค์ความรู้นี้สามารถส่งเสริมประสิทธิภาพของพนักงานสอบสวนไปสู่ความถูกต้อง เป็นธรรม โปร่งใส ตามหลักกฎหมาย
