INTEGRATIVE PROCESS OF LEGAL PRACTICE AND DHAMMAVINAYA PRACTICE TO MONKS DURING THE CRIMINAL PROCEEDINGS

Abstract

This research, entitled “An Integrated Process for the Treatment of Buddhist Monks during Criminal Proceedings in Accordance with Law and Buddhist Discipline (Vinaya),” aimed to: (1) study the problems concerning the investigation process involving Buddhist monks during criminal proceedings; (2) study the laws and Buddhist Discipline (Vinaya) relevant to the investigation process involving Buddhist monks during criminal proceedings; (3) develop an integrated process for the treatment of Buddhist monks during criminal proceedings in accordance with law and Buddhist Discipline; and (4) propose a body of knowledge concerning an integrated process for the treatment of Buddhist monks during criminal proceedings in accordance with law and Buddhist Discipline. This study employed a qualitative research methodology. Data were obtained from the Tipitaka, relevant documents, concepts, theories, Supreme Court judgments, related research studies, and Buddhist principles concerning the treatment of Buddhist monks during criminal proceedings in accordance with law and Buddhist Discipline. Data were collected through semi-structured in-depth interviews with 25 key informants and a focus group discussion with 9 participants, totaling 34 participants. The data were analyzed, synthesized, and presented using a descriptive approach. The research findings revealed that: 1.Problems concerning the investigation process involving Buddhist monks during criminal proceedings: The investigation process must adhere to the rule of law, whereby the exercise of state power must be conducted in accordance with fair and lawful principles, as well as the principle of equality guaranteed by the Constitution 2.Laws and Buddhist Discipline (Vinaya) concerning the investigation process involving Buddhist monks during criminal proceedings: The investigation process must be conducted in accordance with both state law and Buddhist Discipline (Vinaya) concurrently. It must ensure fairness and contribute to the preservation of Buddhism, while emphasizing the protection of rights and freedoms guaranteed by the Constitution. 3. Development of an integrated process for the treatment of Buddhist monks during criminal proceedings in accordance with law and Buddhist Discipline (Vinaya): The findings revealed that both state law and Buddhist Discipline (Vinaya) must protect the rights and status of Buddhist monks in accordance with the principles of Sangha administration, while also taking into consideration public faith in Buddhism and the state justice system. 4). Proposed body of knowledge concerning an integrated process for the treatment of Buddhist monks during criminal proceedings in accordance with law and Buddhist Discipline (Vinaya): The findings revealed that: 1).Criminal investigation: The process must be conducted fairly based on the principle of protecting individual rights. 2).Criminal procedure: Buddhist monks must be afforded protection in accordance with constitutional principles. 3).Adjudication: The judicial process must uphold and preserve the presumption of innocence of Buddhist monks. The new body of knowledge developed from this research is the RDJP Model, consisting of: R = Respect — Respect for Buddhist monks D = Discipline — Buddhist Discipline (Vinaya) J = Justice — Justice under the law P = Protection — Protection of Buddhism The RDJP Model is founded upon the concept: “Respect Buddhist monks, uphold Buddhist Discipline, ensure justice through the law, and protect and preserve Buddhism.” The model can be likened to the turning of the Dhamma Wheel (Dhammacakka), symbolizing the continuous movement toward righteousness and justice, leading to a judicial process that is fair, transparent, and grounded in the rule of law and Buddhist Discipline (Vinaya). Its ultimate purpose is to safeguard the Sangha, uphold Buddhist Discipline, and preserve the principles and heritage of Buddhism.

การวิจัยเรื่อง กระบวนการปฏิบัติต่อพระภิกษุระหว่างถูกดำเนินคดีอาญาตามกฎหมาย และพระธรรมวินัยเชิงบูรณาการ โดยมีวัตถุประสงค์ 1) เพื่อศึกษาปัญหากระบวนการสอบสวนพระภิกษุระหว่างถูกดำเนินคดีอาญา 2) เพื่อศึกษากฎหมายและพระธรรมวินัยที่เกี่ยวกับกระบวนการสอบสวนพระภิกษุระหว่างถูกดำเนินคดีอาญา 3) เพื่อพัฒนากระบวนการเชิงบูรณาการการปฏิบัติต่อพระภิกษุระหว่างถูกดำเนินคดีอาญาตามกฎหมายและพระธรรมวินัย 4) เพื่อนำเสนอองค์ความรู้เกี่ยวกับกระบวนการปฏิบัติต่อพระภิกษุระหว่างถูกดำเนินคดีอาญาตามกฎหมายและพระธรรมวินัยเชิงบูรณาการ เป็นงานวิจัยเชิงคุณภาพ (Qualitative Research) โดยศึกษาข้อมูลจากพระไตรปิฏก เอกสาร แนวคิด ทฤษฎี ฎีกาและงานวิจัยที่เกี่ยวข้อง รวมถึงหลักพุทธธรรมที่เกี่ยวกับการปฏิบัติต่อพระภิกษุระหว่างถูกดำเนินคดีอาญาตามกฎหมายและพระธรรมวินัย เก็บข้อมูลจากการสัมภาษณ์เชิงลึกแบบกึ่งโครงสร้าง (Semi-structured In-depth Interview) ผู้ให้ข้อมูลสำคัญจำนวน 25 รูป/คน และการสนทนากลุ่ม 9 รูป/คน รวม 34 รูป/คน นำมาวิเคราะห์ สังเคราะห์ และนำเสนอเชิงพรรณา ผลการวิจัยพบว่า 1. ปัญหากระบวนการสอบสวนพระภิกษุระหว่างถูกดำเนินคดีอาญา พบว่า กระบวนการสอบสวนต้องยึดหลักนิติธรรม การใช้อำนาจของรัฐต้องเป็นไปตามกฎหมายที่เป็นธรรม ความเสมอภาคตามรัฐธรรมนูญ 2. กฎหมายและพระวินัยที่เกี่ยวกับกระบวนการสอบสวนพระภิกษุระหว่างถูกดำเนินคดีอาญา พบว่า กระบวนการสอบสวนต้องอยู่ภายใต้กฎหมายของรัฐและพระธรรมวินัยควบคู่กัน มีความเป็นธรรม รักษาพระศาสนาโดยมุ่งคุ้มครองสิทธิและเสรีภาพตามรัฐธรรมนูญ 3. พัฒนากระบวนการเชิงบูรณาการการปฏิบัติต่อพระภิกษุระหว่างถูกดำเนินคดีอาญาตามกฎหมายและพระธรรมวินัย พบว่า กฎหมายและพระธรรมวินัยต้องคุ้มครองสิทธิและสถานะพระภิกษุตามหลักการปกครองคณะสงฆ์กับการศรัทธาของสังคมต่อพระพุทธศาสนาและกระบวนการยุติธรรมของรัฐ 4. นำเสนอองค์ความรู้เกี่ยวกับกระบวนการปฏิบัติต่อพระภิกษุระหว่างถูกดำเนินคดีอาญาและพระธรรมวินัยเชิงบูรณาการ พบว่า 1) ด้านการสอบสวนคดีอาญาต้องอยู่บนความเป็นธรรมโดยยึดหลักการคุ้มครองสิทธิบุคคล 2) ด้านวิธีพิจารณาความอาญาต้องได้รับการคุ้มครองตามหลักรัฐธรรมนูญ 3) ด้านพิจารณาคดีต้องรักษาความบริสุทธิ์ของพระภิกษุ องค์ความรู้ใหม่ RDJP Model ประกอบด้วย R = Respect (ความเคารพพระภิกษุสงฆ์) D = Discipline (วินัย) J = Justice (ความยุติธรรม) P = Protection (การคุ้มครอง) ภายใต้แนวคิด “เคารพพระภิกษุสงฆ์ หลักพระธรรมวินัย ยุติธรรมด้วยกฎหมาย ปกป้องคุ้มครองพระพุทธศาสนา” เปรียบเสมือนการขับเคลื่อนของธรรมจักรที่หมุนไปแห่งความถูกต้อง เป็นธรรมอันนำเป็นไปสู่กระบวนการยุติธรรม โปร่งใส ตามหลักนิติธรรมและพระวินัย เพื่อรักษาพระสงฆ์ ธำรงไว้ซึ่งพระธรรมวินัยตามพระพุทธศาสนา
