dc.description.abstract This dissertation, entitled “Buddhist Principles Influencing Mediation Negotiations for Dispute Resolution: A Study of the Office of the Consumer Protection Board,” aimed to: (1) examine the consumer dispute mediation process in Thai society; (2) investigate Buddhist principles that play a role in dispute mediation; and (3) propose guidelines for applying Buddhist principles to enhance consumer dispute mediation. This study employed a qualitative research methodology. Data were collected through documentary research, including relevant concepts, theories, and related studies. In-depth interviews were conducted with 20 key informants, and focus group discussions were held with 12 experts and specialists. Data were analyzed using descriptive content analysis and contextual interpretation, while data credibility was verified through triangulation. The results of study were shown as follows: 1) The findings revealed that the consumer dispute mediation process administered by the Office of the Consumer Protection Board (OCPB) operates as a systematic Alternative Dispute Resolution (ADR) mechanism. The process consists of several stages, including complaint submission, fact verification, mediation negotiation, and settlement agreement formulation. The process emphasizes the active participation of disputing parties in seeking mutually acceptable solutions. However, the effectiveness of mediation depends not only on procedural structures but also on the mediator’s competency in communication, active listening, trust-building, and conflict management, all of which significantly contribute to successful dispute resolution. 2) The study further found that several Buddhist principles play an important role in the mediation process, namely the Four Sublime States of Mind (Brahmavihāra 4), the Four Bases of Social Solidarity (Saṅgahavatthu 4), the Four Bases of Success (Iddhipāda 4), and the Four Noble Truths (Ariyasacca 4). The Brahmavihāra 4 promote loving-kindness, compassion, empathy, and impartiality among mediators. The Saṅgahavatthu 4 facilitate constructive communication, cooperation, and mutual understanding between disputing parties. The Iddhipāda 4 strengthen commitment, perseverance, diligence, and responsibility in the performance of mediation duties. Meanwhile, the Four Noble Truths provide a systematic framework for identifying the causes of disputes, analyzing underlying problems, and developing appropriate solutions. These principles collectively contribute to fairness, effectiveness, and sustainability in the mediation process. 3) Regarding the application of Buddhist principles to consumer dispute mediation, the study found that mediators should be encouraged to integrate Buddhist teachings into their professional practice, particularly in decision-making, communication, conflict management, and ethical conduct. At the same time, mediation procedures should be developed to ensure flexibility, transparency, and responsiveness to the specific circumstances of each dispute. Furthermore, monitoring and evaluation mechanisms should be established to assess mediation outcomes and strengthen public confidence, participant satisfaction, and the long-term sustainability of dispute resolution. In addition, the study synthesized a new body of knowledge in the form of the BMED Model, comprising B = Buddhist Principles, M = Mediator Competency, E = Effective Mediation Process, and D = Dispute Resolution Outcomes. The model explains the causal relationship among these four components. Buddhist principles serve as the foundational factor in developing mediator competency, which subsequently enhances the effectiveness of the mediation process and leads to fair, acceptable, and sustainable dispute resolution outcomes. The BMED Model therefore provides a conceptual framework for integrating Buddhist principles into consumer dispute mediation and contributes to the development of effective and sustainable dispute resolution practices within the context of consumer protection in Thailand.en
dc.description.abstractดุษฎีนิพนธ์เรื่อง “หลักธรรมที่มีผลต่อการเจรจาไกล่เกลี่ยเพื่อระงับข้อพิพาท โดยทำการศึกษาจากสำนักงานคณะกรรมการคุ้มครองผู้บริโภค” มีวัตถุประสงค์ดังนี้ 1) เพื่อศึกษากระบวนการไกล่เกลี่ยข้อพิพาทในคดีผู้บริโภคในสังคมไทย 2) เพื่อศึกษาหลักธรรมทางพระพุทธศาสนาที่อาจมีบทบาทต่อกระบวนการไกล่เกลี่ยข้อพิพาท และ 3) เพื่อเสนอแนวทางการประยุกต์หลักธรรมทางพระพุทธศาสนาในการส่งเสริมกระบวนการไกล่เกลี่ยข้อพิพาทในคดีผู้บริโภค เป็นการศึกษาวิจัยเชิงคุณภาพ โดยศึกษาข้อมูลจากเอกสาร แนวคิด ทฤษฎี และงานวิจัยที่เกี่ยวข้อง ใช้การสัมภาษณ์เชิงลึกกับผู้ให้ข้อมูลสำคัญ จำนวน 20 คน และการสนทนากลุ่มเฉพาะกับผู้ทรงคุณวุฒิและผู้เชี่ยวชาญ จำนวน 12 รูป/คน วิเคราะห์ข้อมูลด้วยเทคนิคการวิเคราะห์เนื้อหาเชิงพรรณนา ประกอบการตีความตามบริบท และตรวจสอบความน่าเชื่อถือของข้อมูลด้วยเทคนิคการตรวจสอบแบบสามเส้า ผลการวิจัยพบว่า 1) กระบวนการไกล่เกลี่ยข้อพิพาทในคดีผู้บริโภคของสำนักงานคณะกรรมการคุ้มครองผู้บริโภคเป็นกระบวนการระงับข้อพิพาททางเลือกที่มีลำดับขั้นตอนการดำเนินงานอย่างเป็นระบบ ตั้งแต่การรับเรื่องร้องทุกข์ การตรวจสอบข้อเท็จจริง การเชิญคู่กรณีเข้าสู่กระบวนการเจรจาไกล่เกลี่ย ตลอดจนการจัดทำข้อตกลงยุติข้อพิพาท โดยมุ่งเน้นการเปิดโอกาสให้คู่กรณีมีส่วนร่วมในการแสวงหาทางออกร่วมกัน อย่างไรก็ตาม ความสำเร็จของกระบวนการไกล่เกลี่ยมิได้ขึ้นอยู่กับขั้นตอนการดำเนินงานเพียงอย่างเดียว แต่ขึ้นอยู่กับความสามารถของผู้ไกล่เกลี่ยในการสื่อสาร การรับฟัง การสร้างความไว้วางใจ และการบริหารจัดการความขัดแย้งอย่างเหมาะสม 2) หลักธรรมทางพระพุทธศาสนาที่มีบทบาทต่อกระบวนการไกล่เกลี่ยข้อพิพาท ได้แก่ พรหมวิหาร 4 สังคหวัตถุ 4 อิทธิบาท 4 และอริยสัจ 4 โดยหลักพรหมวิหาร 4 ช่วยส่งเสริมความเมตตา กรุณา และความเป็นกลางของผู้ไกล่เกลี่ย หลักสังคหวัตถุ 4 ช่วยสนับสนุนการสื่อสารและการสร้างความร่วมมือระหว่างคู่กรณี หลักอิทธิบาท 4 ช่วยเสริมสร้างความตั้งใจ ความเพียร และความรับผิดชอบในการปฏิบัติหน้าที่ ส่วนหลักอริยสัจ 4 สามารถประยุกต์ใช้เป็นกรอบแนวคิดในการวิเคราะห์สาเหตุของข้อพิพาทและกำหนดแนวทางแก้ไขปัญหาอย่างเป็นระบบ ส่งผลให้การไกล่เกลี่ยเป็นไปอย่างมีประสิทธิภาพและเป็นธรรม 3) แนวทางการประยุกต์หลักธรรมทางพระพุทธศาสนาในการส่งเสริมกระบวนการไกล่เกลี่ยข้อพิพาทในคดีผู้บริโภค ควรมุ่งเน้นการพัฒนาผู้ไกล่เกลี่ยให้สามารถบูรณาการหลักพุทธธรรมเข้ากับการปฏิบัติงานจริง ทั้งด้านการคิด การตัดสินใจ การสื่อสาร และการจัดการความขัดแย้ง ควบคู่กับการพัฒนากระบวนการไกล่เกลี่ยให้มีความยืดหยุ่น โปร่งใส และสอดคล้องกับบริบทของข้อพิพาทแต่ละกรณี รวมทั้งส่งเสริมระบบติดตามและประเมินผลภายหลังการไกล่เกลี่ย เพื่อสร้างความเชื่อมั่น ความพึงพอใจ และความยั่งยืนของผลการระงับข้อพิพาท นอกจากนี้ ผู้วิจัยได้สังเคราะห์องค์ความรู้ใหม่ในรูปแบบ BMED Model ประกอบด้วย B = Buddhist Principles (หลักพุทธธรรม) M = Mediator Competency (สมรรถนะผู้ไกล่เกลี่ย) E = Effective Mediation Process (กระบวนการไกล่เกลี่ยที่มีประสิทธิภาพ) และ D = Dispute Resolution Outcomes (ผลลัพธ์ของการระงับข้อพิพาท) โดยเป็นกรอบแนวคิดที่อธิบายความสัมพันธ์เชิงเหตุและผลระหว่างหลักพุทธธรรม สมรรถนะของผู้ไกล่เกลี่ย ประสิทธิภาพของกระบวนการไกล่เกลี่ย และผลลัพธ์ของการระงับข้อพิพาท ซึ่งแสดงให้เห็นว่า หลักพุทธธรรมเป็นปัจจัยพื้นฐานในการพัฒนาสมรรถนะของผู้ไกล่เกลี่ย อันนำไปสู่การดำเนินกระบวนการไกล่เกลี่ยที่มีประสิทธิภาพ และส่งผลให้เกิดการระงับข้อพิพาทที่เป็นธรรม ยอมรับได้ และยั่งยืน สอดคล้องกับบริบทการคุ้มครองผู้บริโภคในสังคมไทยth
